Notification to Southwest Preparatory School District Parents and Students of rights under FERPA

The Family Educational Rights and Privacy Act (FERPA) affords parents and students over 18 years of age ("eligible students") certain rights with respect to the student's education records. They are:

(1) The right to inspect and review the student's education records within 45 days of the day the District receives a request for access. Parents should submit a written request to the principal that identifies the record(s) they wish to inspect. The principal will make arrangements for access and notify the parent or eligible student the time and place where the records may be inspected. (2) The right to request the amendment of the student's educational records that the parent or eligible student believes are inaccurate or misleading. They should write to the principal and clearly identify the part of the record whey want changed and why it is misleading or inaccurate. If the District decides not to make the change, the parent will be notified and explained their rights. (3) The right to consent to disclosures of personally identifiable information contained in the student's education records, except to the extent that FERPA authorizes disclosure without consent. If a school official has a legitimate educational interest to review the records in order to fulfill his or her professional responsibilities, the consent is not necessary. (4) The right to file a complaint with the U.S. Department of Education concerning alleged failures of the District to comply with the requirements of FERPA. Notificación a los Padres y Estudiantes del Distrito Southwest Preparatory de sus derechos bajo FERPA

La Ley de Privacidad y de Derechos Educativos de la Familia (FERPA, por sus siglas en ingles) les proporciona a los padres y a los estudiantes de más de 18 anos de edad (“estudiantes elegibles”), ciertos derechos en relación a los registros de educación. Estos son:

(1) El derecho a inspeccionar y revisar los registros de educación del estudiante, 45 días a partir del día en que el Distrito recibe la solicitud. Los padres deben entregarle al director(a) una solicitud por escrito, en la que se especifican los registros que se desea inspeccionar. El director hará los arreglos necesarios para dar acceso y lo notificara a los padres o al estudiante elegible, la hora y el lugar en el que Se pueden inspeccionar los registros. (2) El derecho a solicitar una enmienda de los registros educativos del estudiante que el padre o el estudiante elegible considera que son incorrectos o engañosos. Necesitan escribirle al director(a) y identificar claramente la parte del registro que desean cambiar y porque es incorrecto o engañoso. Si el Distrito decide no hacer la modificación, el padre de familia será notificado y se le explicara sus derechos. (3) El derecho a consentir el hacer publica información personal que aparece en los registros de los registros del estudiante, exceptuando lo permitido por FERPA sin necesidad de consentimiento. Si un funcionario escolar tiene un legítimo interés educativo en revisar los registros para cumplir con sus responsabilidades, entonces no es necesario el consentimiento. (4) El derecho de presentar una queja con el Departamento de Educación de los Estados Unidos, en relación a supuestas fallas del Distrito para cumplir con los requerimientos de FERPA.
